Terms of Use
1. Agreement to these terms
These Terms of Use (the "Terms") apply to your use of the website at storagecore.xyz (the "Site"). The Site is operated by StorageCore, a private limited company registered in Kenya that works as an independent AWS storage consultancy based in Nairobi ("StorageCore"). In these Terms, "I", "me" and "my" also mean StorageCore.
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
2. The Site is general information, not advice
Everything on the Site is general information about the services I offer. It is not professional, technical, legal, financial or compliance advice for your particular situation, and you should not rely on it as such.
Visiting the Site, emailing me, calling me, or booking or attending a free bill review does not create a client relationship or any obligation on either side. A client relationship exists only once we have both agreed a written proposal, statement of work or services agreement (a "Services Agreement").
Prices shown on the Site, including "from" prices, are indicative starting points and are not binding offers. The price for any work is the price confirmed to you in writing before work starts.
3. Services are governed by a separate written agreement
Any consulting, audit, setup, migration, review or support work is provided only under a Services Agreement. If these Terms conflict with a Services Agreement about the services, the Services Agreement prevails. These Terms continue to govern your use of the Site.
4. No guarantees or promises of results
I do not guarantee any particular result. In particular, I do not guarantee or warrant:
- any amount of cost savings, or that any recommendation will reduce your cloud costs;
- the performance, availability, uptime, durability or recoverability of any system or data;
- that any backup, replication, failover or restore will work in every circumstance, or that any data will be fully recoverable;
- the security of any system, or that any vulnerability, misconfiguration or breach will be found or prevented; or
- that any outcome will satisfy a regulator, auditor, insurer or contract.
Descriptions of my background and experience, examples, estimates and savings or time ranges are for illustration only and are not typical or guaranteed results. Cloud pricing, services and features change, and AWS may change them without notice.
5. No legal, audit or certification services
I am not a law firm, an auditor or an accredited assessor. References to GDPR, HIPAA, PCI-DSS or any other law, standard or framework describe the kind of requirements I design storage around. They do not mean that StorageCore, or any system I work on, is certified, audited, approved or compliant, and they are not legal advice.
You remain solely responsible for your own legal and regulatory compliance. Obtain advice from a qualified legal or compliance professional, and use an accredited assessor where formal verification is required.
6. Your responsibilities
If you engage me, you agree that, unless the Services Agreement says otherwise:
- You are responsible for keeping your own independent, current and tested backups of your data before any work on your systems begins, and you will not rely on any work of mine as your only copy.
- You will only give me access to systems, accounts and data that you own or are authorised to share, and you are responsible for the permissions you grant.
- You are responsible for deciding whether to apply any recommendation, for reviewing it first, and for testing changes outside production where appropriate.
- You are responsible for all charges from AWS and any other third party in your accounts, including charges that result from services you enable or recommendations you apply.
- You will keep your credentials secure and will remove or rotate any access you gave me when the work ends.
7. Independence from AWS and third parties
StorageCore is an independent consultancy. It is not affiliated with, endorsed by or sponsored by Amazon or Amazon Web Services ("AWS"). AWS and the names of AWS services are trademarks of Amazon.com, Inc. or its affiliates, and I use them only to describe the services I work with. Other names may be trademarks of their owners.
The Site may link to third-party websites, such as certification or professional profiles. I do not control those sites, I am not responsible for their content or practices, and a link is not an endorsement. Third-party services you use are governed by their own terms.
8. Intellectual property
The Site, its text, design and other content belong to StorageCore or its licensors and are protected by intellectual property laws. You may view the Site and share links to it. You may not copy, republish, sell or build on the Site's content without my written permission, except as the law allows.
Ownership of reports and other deliverables produced for a client is set out in the Services Agreement.
9. Acceptable use
You agree not to use the Site to:
- break any law or the rights of others;
- attempt to gain unauthorised access to the Site, its hosting or any related system, or to probe, scan or test its security;
- introduce malware or interfere with the Site's operation; or
- scrape or copy the Site in a way that burdens it, or impersonate any person or organisation.
10. Contacting me, confidentiality and sensitive information
Messages sent through the Site, by email or by phone are not confidential until a Services Agreement or a written confidentiality agreement says so. Do not send passwords, AWS access keys, secret keys, tokens, private keys or sensitive personal, financial or health data by email or any other unprotected channel. If you do, you do so at your own risk, and I may delete it.
How I handle personal information is described in my Privacy Policy.
11. Disclaimer of warranties
The Site and everything on it are provided "as is" and "as available". To the fullest extent permitted by law, StorageCore disclaims all warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted or error-free operation. I do not warrant that the Site will be available, secure or free of errors or harmful components.
12. Limitation of liability
To the fullest extent permitted by law:
- StorageCore will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, data, goodwill or anticipated savings, business interruption, or the cost of substitute services, however caused and whatever the legal theory, even if I have been told such loss is possible.
- StorageCore will not be liable for any charges, fees or costs you incur with AWS or any other third party, or for any outage, data loss or security incident that arises from the actions of you, your personnel or any third party, or from the failure of any third-party service.
- For any claim arising from your use of the Site, StorageCore's total liability will not exceed US$100.
- For any claim arising from services I provide, StorageCore's total aggregate liability will not exceed the fees you paid to StorageCore for the particular service that gave rise to the claim, unless the Services Agreement states a different limit.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for fraud or for death or personal injury caused by negligence. Some jurisdictions do not allow certain limits, so some of the above may not apply to you.
13. Indemnity
You agree to indemnify and hold harmless StorageCore against any claims, losses, liabilities, damages and reasonable costs (including reasonable legal fees) arising from: your breach of these Terms or a Services Agreement; your misuse of the Site; your data or systems, or your lack of authority to give me access to them; or your violation of any law or third-party right.
14. Events outside my control
I am not responsible for any failure or delay caused by events beyond my reasonable control, including outages or changes at AWS or other providers, internet or power failures, government action and natural events.
15. Suspension and termination
I may suspend or end your access to the Site at any time, without notice, if I think you have broken these Terms or for any other reason. Sections that by their nature should continue, including those on disclaimers, liability, indemnity and governing law, will continue after your access ends.
16. Changes to these terms
I may update these Terms from time to time. The date at the top of this page shows when they were last changed. By continuing to use the Site after a change you accept the updated Terms.
17. Governing law and disputes
These Terms are governed by the laws of Kenya, without regard to conflict-of-law rules. If a dispute arises, please first write to me at the email address below so we can try to resolve it informally within 30 days. If we cannot, the courts of Kenya sitting in Nairobi have exclusive jurisdiction, unless a Services Agreement says otherwise or the law requires otherwise.
18. General
If any part of these Terms is found unenforceable, the rest remains in effect. My not enforcing a right is not a waiver of it. These Terms, together with any Services Agreement, are the entire agreement between us about the Site and replace earlier understandings about it. You may not transfer your rights under these Terms. Electronic communications satisfy any requirement that notices be in writing.
